Slip and Fall Accidents

Injuries resulting from slipping on wet or slippery surfaces or tripping on uneven pavement, holes or unexpected items on the floor can cause injury, and often serious injury. If the property owner allowed the danger to exist on the property or failed to warn patrons of these dangers, these injuries may be the responsibility of the property owner.

Generally, falls are caused by one or more of the following dangerous conditions:

- Allowing liquid or other slippery substances to remain on the premises.

- Improper cleaning that leaves the premises slippery.

- Damage on the premises such as potholes, cracks and uneven pavement.

- Inadequate of missing lighting in walk areas and stairwells.

- Failure to keep premises free from debris, items or clutter.

- Failing to warn of any danger. This includes failing to post wet floor signs, notifications of uneven pavement or flooring or warnings of other dangerous areas to walk in as well as failing to paint any curb, step, speed bump, parking bumper or other obstacle or change in flooring in a distinct highly visible color.

Though these are the most common, there are a number of ways a fall may occur and property owners are often responsible.

Unlike most motor vehicle accidents where there is a police report and other evidence of the crash such as vehicle damage, slip and fall cases often rely solely on the victim’s testimony. As such it is very important you collect as much evidence as possible to preserve your case. Immediately after a fall you should:

- Tell Someone: Call for an employee and have a manager come to the scene. Request they file an incident report and request a copy.

- Take Pictures: Take pictures of the area where you fell and the cause of your fall be it water, uneven pavement, etc.

- Talk to Others in the Area: Talk to anyone who may have seen the fall and obtain their contact information.

- Keep Notes: Write down everything you remember about the fall. The area where you fell, how you fell, any employee names who interacted with you, witness names, etc.

- Keep your Shoes: The shoes you were wearing can be evidence in the case. Take photographs of the soles of your shoes, stop wearing them and place them in a plastic zip lock bag to keep them safe as evidence. If your clothes have any of the liquid on them, this may be evidence as well.

- Write it Down: As soon as practicable, write down everything that you can remember about the accident, including employee’s names.
